Terms of Service

The terms that apply to Filaway subscriptions, this website and associated services.

Who provides Filaway

Your agreement

These terms apply to Filaway subscriptions, the website and associated services. Before purchasing, review your selected plan or written quote, these terms, the Refund Policy, Cancellation Policy and Service Delivery information.

If you purchase on behalf of an organisation, you must have authority to bind it. Any separately signed agreement governs matters it expressly addresses. No agreement removes rights that applicable law makes mandatory.

Account access and responsibilities

Provide accurate account information, protect your login credentials and allow access only to authorised users. Tell us promptly if you suspect unauthorised access. You are responsible for your organisation's permissions, the lawfulness of information it submits and the instructions it gives its users.

Filaway connects operational records. Your organisation remains responsible for its business decisions, safety procedures and legal obligations. Information shown depends on the records submitted and, where relevant, their synchronisation. The software does not replace professional judgement or required physical safety controls.

Plans and charges

Filaway has no free plan. The plan or quote you accept states the access purchased, billing unit, billing period, currency, total payable amount and applicable limits. Optional onboarding is separately quoted and is not required to access your subscription.

Where you authorise recurring payments, your subscription renews for the billing period displayed at checkout until cancelled. We do not apply a new price retrospectively to a period already paid for. We notify you of a proposed renewal price increase before it applies, allowing you to cancel rather than renew at the new price.

You may cancel at any time under the Cancellation Policy. Paid access continues to the end of the paid period unless ended earlier following a refund or lawful termination. Our seven-day first-payment refund offer is set out in the Refund Policy.

Delivery and service changes

Access is supplied online after successful payment confirmation and completion of account creation and required verification. Assisted onboarding has its own agreed schedule. See Service Delivery for details.

We may maintain and improve Filaway. We will not knowingly remove a material part of your purchased service without addressing the effect on your subscription. We use reasonable care and skill to provide the service, but do not promise uninterrupted availability, specific business results or compatibility with every external system.

Acceptable use

Do not use Filaway to break the law, infringe another person's rights, access another organisation's information without permission, introduce malicious software or interfere with the service. Do not resell access or copy protected software or branding without permission, except where the law permits it.

Your information and our intellectual property

Your organisation retains its rights in the information it supplies. It authorises us to process that information to provide and secure the service and fulfil lawful instructions. This does not transfer ownership of your records to us.

WorkLinker and its licensors retain their rights in Filaway's software, design, branding and documentation. Your subscription provides a limited right to use the purchased service during the subscription period.

The Privacy Policy describes personal-information handling. An organisation that submits information about workers or other individuals must have a lawful basis and provide required notices. Where we process operational personal information on your organisation's behalf, it determines the processing purposes and we act on its lawful instructions, subject to applicable law.

Suspension and ending access

We may restrict access where reasonably necessary to respond to a security threat, unlawful use or a material breach. For payment problems or remediable breaches, we will normally give notice and an opportunity to resolve the issue. Urgent action may be necessary to protect users or comply with law.

If we end a paid service without fault on your part, we refund the prepaid amount attributable to the service we will not provide. Ending access does not remove your applicable refund or data-protection rights.

Problems and remedies

Contact support@filaway.com if the service is not supplied as agreed. We will investigate and seek to correct the problem. Where correction is not possible, you retain the cancellation, refund and other remedies available under your agreement and applicable law. Nothing in these terms excludes liability or a warranty that cannot lawfully be excluded.

Changes and disputes

We publish updated terms with their effective date and give appropriate notice of material changes. Changes do not retrospectively remove rights attached to a purchase already made.

South African law governs these terms, subject to mandatory protections that apply to you. Please contact us first with a dispute so we can try to resolve it. This does not prevent you from approaching a competent court, regulator or dispute-resolution body.
